On 18 March 2016, a Royal Decree (RD) enabling night work for e commerce activities in the distribution sectors was published. This RD provides for working-time arrangements with night work to be introduced at company level in these sectors.
Recently, sectoral collective bargaining agreements (CBAs) in the sectorial committees 201 (independent retail), 202 (retail in foodstuffs), 202.01 (medium sized food stores), 311 (large retail) and 312 (general stores) made it possible to introduce working-time arrangements with night work for e-commerce activities. An RD was still necessary to allow this form of night work in these distribution sectors (see our Newsflash of 27 January 2016).
This RD of 13 March 2016 was published on 18 March 2016 in the Belgian Official Gazette. It states that night work for e-commerce activities is now allowed in the distribution sector on condition that the nature of the work or the activities justify the night work. The employer will have to prove this.
The RD enters into force on 29 March 2016.
As from 29 March 2016 employees in the distribution sector can work at night for e-commerce activities and working-time arrangements with night work can be introduced to this end at company level.
